I. Rules of Use

The use of self-service facilities (self-service vacuum cleaners, self-service wash bays and self-service machines) is permitted only for cleaning vehicles and only under the following conditions:

1.) The operating instructions of the operator and the operating personnel must be followed.

2.) Please observe the posted height restrictions! These are 2.40 m in the self-service wash bay and 3.80 m in the open wash bay. When using all functions, please maintain a minimum distance of 30 cm from the vehicle.

The wash bays are exclusively intended for cars, minibuses, station wagons and motorcycles up to a maximum permissible total weight of 2.8t, as well as for two-wheelers. Other vehicles such as small trucks, commercial vehicles, caravans and off-road vehicles of any kind may only be cleaned in the designated free-washing area. Cleaning other vehicles (especially construction site vehicles) and objects is not permitted. Oil, brake fluid or transmission oil changes, as well as repair and maintenance work, are expressly prohibited.

3.) Before putting the self-service facilities into operation, the user must ensure that they are in proper working order. Only then may the facilities be used.

If the equipment is visibly damaged or defective, the user must either inform the operating staff or go to another car wash bay before using it. This obligation to report damage also applies if damage occurs during or after use of the self-service car wash facilities. If it becomes apparent that the washing process could damage the equipment or the vehicle, the washing must be stopped immediately.

4.) Should a fault occur in the system during the wash, or should it become apparent that continuing the wash could damage the vehicle or the system, the wash must be stopped as quickly as possible (rotary switch to STOP) and the operator must be informed immediately.

5.) The self-service car wash may only be used for its intended purpose, i.e., for cleaning normally soiled vehicles (exterior washing). The parts of the self-service car wash and its components must not be used against other people or animals. They must also not be used for interior cleaning of the vehicle.

6.) The washing area must be left clean after cleaning.

7.) The user must notify the plant operator/staff of any claims for compensation due to obvious damage before leaving the premises; otherwise, the operator's liability is excluded, unless the operator or his staff caused the damage through gross negligence or intent.

8.) Cleaning agents other than those offered in the facility may not be used.

9.) Only waste from the immediate cleaning of the vehicle may be disposed of in the existing waste containers. Household waste or commercial waste must not be left behind.

10.) Liability for damages resulting from injury to life, body or health is excluded, unless it is based on gross negligence or intent on the part of the operator or its agents.

11.) The operator is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

12.) The regulations of the German Road Traffic Act (StVO) apply accordingly on the premises of the facility. Use of the facility is at your own risk.

II. Warranty, Liability

1.) We guarantee proper and gentle cleaning of the vehicles in accordance with the state of the art. If, due to technical defects, the vehicles are not cleaned adequately, the user must immediately report any claims for rectification to the operating staff. Defects reported later cannot be considered.

2.) Claims for compensation due to obvious damage can only be made if the damage has been reported to the operating staff before leaving the premises; damage reported later cannot be taken into account.

3.) Liability for accidents caused by black ice is only accepted if the operating personnel intentionally or through gross negligence failed to remove the ice.

4.) In the event of damage to the vehicle during the cleaning process, we are only liable for direct damage. Consequential damages, in particular compensation for loss of use, depreciation, or the use of a rental car, will not be reimbursed unless the liability is based on intent or gross negligence.

5.) Furthermore, we are not liable for damages caused by failure to comply with the rules of use or instructions for use, unless the contributory negligence is based on intent or gross negligence.
